Luke Nelmes, of Belton Street in Moldgreen, appeared before Kirklees magistrates yesterday and admitted being drunk and disorderly in public on July 13.

Linda Fowler, prosecuting, said the incident happened at the Southgate branch of Sainsbury’s at 6pm as police officers on a meal break headed to the store.

Mrs Fowler said: “The officers heard a commotion with shouting and swearing. They saw the defendant swearing at another male who had a trolley with a young child.

“The officers went to speak to the defendant who was unsteady on his feet and smelt strongly of intoxicants.”

Magistrates heard that Nelmes, 20, then grabbed one of the officers by his arm before letting go. He then pushed past police in an attempt to run away but was detained. Nelmes swung a punch towards them but missed.

Mike Sisson-Pell, mitigating, said the original incident was ‘horseplay’ between friends

He said: “The officers who attended misinterpreted what was going on and grabbed him. They were not wearing uniform and any normal person would pull away.”

Magistrates ordered Nelmes to pay £100 fine as well as £85 costs and £20 victim surcharge.
