Council defends itself on judge's stinging crown court attack

“An offence of depositing of controlled waste can be heard in either the Magistrates or Crown Court because it can include serious fly-tipping (for example of contaminated waste) which would be prosecuted under Section 33 but can also include much lesser offences.
“The proceedings against Miss Wilkinson were issued in good faith on the basis that we had clear evidence that an offence had been committed.
“Hopefully, proposed changes to the littering offence legislation will be made so that local authorities do have clear and appropriate powers to deal with littering from vehicles.”
