Huddersfield KFC diner in racial abuse to staff

Mike Sisson-Pell, defending, said the police officers had handled Lashington firmly and the defendant had acted beyond what was considered self defence.

He said a police officer had spun Lashington round, pushed him against a window and pushed his face into the pavement.

He said Lashington had spat to get dirt and grit out of his mouth and hadn’t intentionally spat at the officers.

Mr Sisson-Pell said: “He went into the KFC in good humour with his friend.

“The guy serving at the counter couldn’t speak English at all and they couldn’t tell him what they wanted.

“In frustration he said the things that have been outlined to the court.

“It is right to say that in this day and age you can’t remonstrate with somebody about their nationality or religious background because if you do it’s said to be racially aggravated.

“While 10 years ago that wouldn’t have been an offence, now it is.”

Chairman of the magistrates, David Worboys, gave Lashington an 18 month supervision order.

He was also ordered to pay £80 costs.
