Pub closed for first time using Asbo
A LANDLADY has been banned from her own pub in the first Asbo hearing of its kind in Kirklees.
But a judge said The Swan, Station Road, Marsden, had been a victim of commercial pressures.
The pub, which was licensed until 12am on weekdays and 2.30am on weekends, was yesterday ordered to close by a district judge in Huddersfield following complaints of loud music, shouting and fighting until the small hours.
Landlady Mandy Hester, who took over the premises in October, has been banned from entering any of the licensed premises.
But Miss Hester and up to five guests have been allowed to enter the pub’s living quarters until September 24 when owner Thwaites Brewery is expected to take charge of the building.
The order is the first time an anti-social behaviour order has been granted to close a pub in Kirklees.
But passing the order District Judge Richard Manning said Miss Hester had been forced by pressures from the brewery to increase trade.
Judge Manning said: “Commercial pressures from breweries have forced tenants to increase footfall and sell more alcohol.
“Miss Hester followed a well established route, including karaoke and live music, and I notice reading the statements that most of the incidents were in June and July when the weather is warmer and people have their windows open. One added issue is the smoking ban which means people go outside. Of course it adds to noise and disorder.
