Pub closed for first time using Asbo
“I notice a complaint at 9.30pm. That was unreasonable but some were at 2.30am and that clearly was in breach of the licence.
“I am satisfied that the use of the premises has been associated with persistent and serious nuisance to members of the public.”
Following the judgement Miss Hester said: “In order to promote a business which is a public house you need entertainment these days. I did the entertainment and people came in.
“You’ve got people coming in and out; of course there’s going to be noise.”
A spokesman for Kirklees Council said: “The Swan Public House has been closed to prevent the significant and persistent serious nuisance that has been occurring there...
“One local resident has informed Environmental Services that they had lived near The Swan for 17 years and until October 2008, had found it an agreeable experience and a useful facility.
“Since Mandy Hester had become landlady their lives had been made miserable by frequent loud, late-night music clearly audible throughout their home and which prevented sleep.”
