A MELTHAM tartan supplier was on the losing side of a legal battle yesterday.

N B Fabrics of Highfield Crescent had denied infringing copyright with its Spring Meadow design.

Guiseley-based Abraham Moon took action against N B Fabrics and Art Of The Loom, of Clitheroe in Lancashire, who sold the material.

Abraham Moon – whose customers include Ralph Lauren, Dolce & Gabbana, Burberry, Lacoste, Daks and Paul Smith – claimed that Spring Meadow, was a copy of its Skye Sage design.

N B Fabrics and Art of the Loom denied any infringement.

But Judge Colin Birss QC ruled in favour of Abraham Moon after a Patents County Court hearing in London yesterday.

The judge said Abraham Moon took legal action after a director saw a chair in John Lewis covered in a fabric that he thought was a copy.

The court heard that Skye Sage was part of Abraham Moon’s Heritage Collection, which also included Highland, Loch, Mac and Troon.

Art Of The Loom’s range included Autumn Berry, Olive Grove, Orchard Fruits and Spun Honey.

Judge Birss concluded that Art Of The Loom bosses and NB Fabrics were “liable from infringement of copyright”.
