CALDERDALE Council officers have opposed plans for a temporary marquee at a Brighouse venue.

The marquee in the grounds of the Casa Hotel and Restaurant, Elland Road, was put up in 2007 without planning permission.

But Casas owner, Jack McDaid, was last month granted a venue licence for the premises which included events staged in the marquee.

However, a planning application for the marquee will be put to councillors on Tuesday and a council report shows planning officers have recommended refusal.

The marquee saga has been ongoing since 2007. In July of that year permission was refused for the 330sqm tent as it was in greenbelt land.

An Enforcement Notice was issued in February 2008 and they had 12 months to comply with it.

An Enforcement Notice Appeal was dismissed by the Planning Inspector in January 2009 and they had a further 12 months to comply.

Casa kept the marquee up, yet Calderdale Council failed to take any action.

In May 2009 planning permission was approved for an extension to the hotel in the same position as the marquee, but work is yet to get under way.

Two previous applications for the retention of the marquee were refused in 2010, along with plans for 18 log cabins.

Matters came to ahead this summer when it was discovered that the venue had been unlicensed since 2010.

Last month councillors on the Licensing Panel were told that the licence lapsed in 2010 when the company it was registered to dissolved, although fees had been paid by the owner.

The Licensing Panel granted permission for events, such as weddings, at the venue.

Mr McDaid told councillors that the marquee was vital to developing his business, which included plans for a s2m function room which would create 100 jobs.

Clr Scott Benson has supported the application, saying: The application will have a positive effect on the local economy as it will continue to allow this business to flourish and will protect many existing jobs.

The marquee is required for a further temporary period for business viability purposes.

Permission has already been granted for a permanent replacement for the marquee so the principle of the use of this area of the hotel in association with the business activities has already been accepted.

Previous reasons for refusal have been in relation to noise disturbance. The applicant has introduced new sound equipment and re-orientated the sound system to address this and no noise complaints have been received since then.

Councillors will discuss the application on Tuesday at 6pm at Halifax Town Hall.
