A man has been jailed after he helped his brother leave the scene of a shooting in Huddersfield.

Leeds Crown Court heard Kym Walter had fired three shots towards a house in Springbank Road, off Leeds Road, in a revenge attack for an earlier incident outside Deighton Working Men’s Club.

After the shooting his brother went to his aid.

Simon Waley, prosecuting said Adrian drove from the area to his then address in Halifax Road, Birchencliffe, where Kym Walter changed his clothing for some of his brother’s. His own clothes were disposed of in a bin bag

Kym Walter, 25, of Leeds Road, Huddersfield was jailed for a total of six years in January after he admitted possessing a firearm with intent to cause fear of violence on October 11 and producing cannabis.

Adrian Walter, 31, recently of Mount Avenue, Bradford was found guilty by a jury earlier this month of assisting an offender.

He had denied knowing his brother had done anything wrong when he drove him first to the flat and later to Leeds and said his brother had helped himself to the clothes.

Stephen Uttley representing him said he was a man of previous good character who was unlikely to ever be in trouble again. He urged the judge to suspend any prison sentence.

But sentencing Adrian Walter to 15 months in prison, Judge Geoffrey Marson QC said it was too serious to avoid an immediate jail term.

“I want to make it absolutely clear to you I am not sentencing you on the basis you drove your brother to the scene of a crime knowing he was armed with a revolver or pistol and knowing he was going to fire three shots at the home of an entirely innocent person. If that had been the case you would have been charged with the offence itself.”

“I am dealing with you on the basis and the jury found on the clearest possible evidence that you drove him away from the scene, knowing he had been involved in a serious crime, in an attempt to avoid detection by removing him from the scene and to avoid detection by allowing him to use your home to change clothes.”

The judge said also by driving him to Leeds getting him further away from the police. “In doing that, no doubt out of a sense of loyalty to your brother, you played a serious part in what happened. Those who assist after crime must face immediate sentences.”

The judge who sentenced Kym Walter heard he fired shots from a silver handgun towards the home of Andrew Hall following an earlier incident.
