A BRIGHOUSE restaurant and hotel is facing court proceedings.
Calderdale Council is prosecuting Casa in Brighouse over alleged planning breaches.
It relates to a marquee at the Elland Road wedding venue, which is said to fall foul of planning rules.
Jack McDaid, owner of Casa, faces a charge of non-compliance with an enforcement notice, as the business allegedly failed to remove a marquee from the site.
The court proceedings take place on July 19 at Halifax Magistrates Court.
The Planning Inspectorate is considering an appeal in relation to the marquee.
The court action relates solely to the enforcement notice issued in 2008.
