An extension to a popular restaurant and wedding venue could be demolished after it lost an appeal against Calderdale Council’s enforcement notice.

Bosses at Casa Hotel and Restaurant in Elland Road, Brighouse, extended the premises by constructing a three-storey function suite which the company claimed would generate around 38 full-time and 50 part-time well paid jobs.

Its case was that it considered total demolition to be ‘over-enforcement.’

But Calderdale Council was unimpressed by the development and demanded the extension be torn down. Its enforcement notice was issued on July 15, 2014.

Castelite Ltd, Casa’s parent company, appealed against the refusal of application for consent for the proposed extension and also the enforcement notice.

The two parties argued the matter in front of 30 members of the public, some of whom were Casa employees, over four days in June at Halifax Town Hall.

Government inspector Ahsan Ghafoor gave his judgment today.

Dismissing the appeal he said: “I have found the proposed development would cause harm to the Green Belt by reason of inappropriateness.

“The development is unlawful and the extension has been built without the benefit of planning permission.

“The steps required to comply with the notice seek to remedy the breach by restoring the land to its condition before the breach occurred.

“Therefore, nothing short of demolition would achieve the notice’s purposes and I find that the steps required by the notice are not excessive.”

Casa General Manager Sam Holmes said: “Obviously we have just become aware of this decision like everyone else. It is with our legal team as we speak who are looking at it.

“As soon as we have their views we will be able to comment further. There is the possibility of recourse to a further appeal.”
