A man told police his friend was on his way with a “shooter” when they arrested him for being drunk and disorderly.

Craig Maciver, 34, later hurled abuse at the officers and threatened to give them HIV as they put him into a police van.

He appeared at Kirklees Magistrates’ Court where he admitted the offence on June 1.

Andy Wills, prosecuting, said that at 2.30am police were called to an address on Halifax Road in Dewsbury.

They were told about a male banging on neighbours doors and making threats.

When Maciver saw the officers he tried to hide his face and walk away out of sight.

He then fled the area but they stopped him.

Mr Wills said: “He appeared to be highly intoxicated. At the time he was talking on the phone to somebody.

“When he was asked who he was talking to he said: ‘It’s my mate, he’s bringing me a shooter’.”

Magistrates heard that at one point Maciver, of Lewes Fold in Heckmondwike, fell over.

He had blood on his shirt and told police that this was from a fight with a friend.

Maciver was arrested after became aggressive and started to shout and swear.

He was placed in a police vehicle but another vehicle was requested after he vomited in it.

Mr Wills said: “When he was taken out of the vehicle he said ‘I’m going to spit in your face - you’ve now got HIV’.”

Magistrates heard that Maciver had 28 offences on his record, included three public order offences.

They gave him a conditional discharge for six months.

He must still pay £85 costs and £15 victim surcharge.
