Campaigner Colin Anderson is waiting to hear the High Court’s decision on the future of a Victorian landmark.

Mr Anderson, 66, of Golcar, went before a judge in Leeds yesterday to challenge a public inquiry verdict on restoration plans for Butterley Spillway near Marsden.

Yorkshire Water wants to repair the grade II listed reservoir structure with concrete but Kirklees Council refused permission.

The company succeeded in overturning the decision at a public inquiry but Mr Anderson claimed the inspector broke the rules by not allowing him to put alternative suggestions at the hearing.

Retired civil engineer Mr Anderson launched an appeal in court. A decision was reserved and will be announced later.

A spokesman for Yorkshire Water said: “Following Mr Anderson’s challenge today regarding the way in which the Butterley Spillway inquiry was held, we’re hoping to get a decision shortly.

“Our number one priority has always been – and remains – the protection of public safety and we’re keen to get on with this essential scheme which will protect thousands of homes in the nearby area from the risk of dam failure and consequential catastrophic flooding.”

Mr Anderson launched a public campaign in a bid to raise £12,000 to cover his legal fees.
