Police stopped a man who was driving in the dark without lights - and found a bag filled with cans of lager next to him.

John Chapman almost fell over when he left his car and when asked if he had been drinking replied: “Just a little.”

The Mirfield man - who was two-and-a-half times over the legal limit - was banned from the road for almost four years.

Kirklees magistrates were told that at 7.30pm on October 5 police were travelling along Huddersfield Road in Mirfield.

They noticed a stationary Suzuki Swift indicating to turn right at the junction.

The car, being driven by Chapman, had no headlights on.

The officers pulled up alongside the vehicle and asked the 52-year-old to turn his lights on.

He gave the thumbs up as if he understood but then turned onto the road without turning his lights on.

The officers then caused Chapman, of Lowlands Road, to stop his car.

James Weekes, prosecuting, said: “They watched it swerve and come close to the nearside kerb.

“He got out and was swaying and almost fell over.

“There was a carrier bag on the passenger seat with eight cans of lager in that bag.

“When asked if he’d had a drink he said: ‘Just a little’.”

Chapman failed a roadside breath test and was arrested.

Further police station breath tests showed that he had 88 microgrammes in 100 millilitres of breath.

This was two-and-a-half times the legal limit of 35 microgrammes.

Emma Haley, mitigating, said that earlier that day her client and his family had gone to the pub for his uncle’s wake.

He had walked to and from the pub but later decided to drive to the shop.

She said: “No one can be more ashamed of what he’s done.”

Chapman had a previous drink-driving conviction on his record from July 2008.

Magistrates banned him from driving for 44 months.

He must also pay £320 fine, £85 costs and £32 victim surcharge.
