A man assaulted a police officer called to help paramedics trying to treat him.

Joshua Regan, who was so drunk he was incapable of standing, tried to bite PC Ashley Barrett before aiming a large amount of spittle at his face.

Kirklees Magistrates’ Court heard that the 23-year-old had previously been jailed for attacks on police officers.

He pleaded guilty to charges of being drunk and disorderly in public and assaulting a constable in the execution of his duty.

Police were called to King Street in Mirfield at just after 10pm on June 21.

Vanessa Jones, prosecuting, said: “Ambulance staff called police to assist them with a drunk male. When the officers attended they found Mr Regan being restrained on the floor by two paramedics. He was incapable of standing and scrambling around on the floor.”

The Huddersfield court heard that PC Barrett tried to help get Regan to his feet.

Regan responded by lashing out at the officer and they was a struggle as the officers tried to handcuff him.

Mrs Jones said: “He tried to bite PC Barrett’s hand.

“When he was walked towards the police van he spat a huge amount of phlegm towards his face.

“It missed his face but landed on his shoulder.”

Zara Begum, mitigating, explained that her client suffered from ADHD and his choice to drink with the condition caused him to offend.

District Judge Michael Fanning told Regan, of Mirfield, that he had a dreadful record as he had previously received jail terms for assaults on police officers.

He said: “You have a bad record in the way you react to police.

“You can’t behave like this towards people trying to do their job - you deserve to go to prison.”

The judge instead sentenced him to a community order with six months of alcohol treatment and 30 days of activities.

He must also pay £50 compensation to the officer as well as £150 court charge, £85 costs and £60 victim surcharge.
