A landscape gardener who got behind the wheel while twice the legal limit has been banned from the road.

Philip Bowker, of Fleminghouse Lane in Waterloo, admitted to the offence from May 12.

Kirklees magistrates heard that the 43-year-old had just heard some terrible news about his terminally ill father.

Police pulled him over as he drove on Dalton Bank Road at almost double the speed limit.

Bowker showed signs of being in drink and failed a roadside breath test.

Further police station tests showed that he had 69 microgrammes of alcohol in 100 millilitres of breath.

This was almost double the legal limit of 35 microgrammes.

Rachel Sharpe, mitigating, said that her client owned his own landscaping business although was currently acting as full time carer for his terminally ill father.

On the day of the offence they had gone to the hospital and received some depressing news. Bowker had then gone out and drunk three pints, Mrs Sharpe explained.

Magistrates banned him from driving for 18 months.

He must also pay £345 fine, £85 costs and £35 victim surcharge.
