A MAN has appeared in court after ignoring an order to stay away from his ex.

Derek Hemphill, of Highfield Crescent in Meltham, was before District Judge Marie Mallon sitting in Huddersfield yesterday.

He admitted being in breach of his non-molestation order by contacting Michelle Donnell.

The 45-year-old was slapped with the order by the town’s county court in April.

The order, which runs for 12 months, bans Hemphill from having any contact with his ex.

But on August 24 he sent a barrage of texts and emails to her. Sharon Amesu, prosecuting, said Miss Donnell received a total of 12 text messages.

She said: “The defendant said in one: ‘I just wanted to say goodbye Flapjack’.

“He was saying that he was missing the complainant, he wanted her back and was sorry.”

However, the tone of the messages became more unpleasant when Hemphill referred to Miss Donnell’s new boyfriend.

In one message he referred to her new love as a: ‘Fat, mummy’s boy cricket umpire’.

Miss Amesu said: “In another message he said: ‘You’re the most gorgeous woman I’ve ever met. You deserve a real man, not him’.”

The prosecutor said that Miss Donnell called police and reported the order breach.

She said that she just wanted her ex to leave him alone.

Judge Mallon was told that last month Hemphill was sentenced at crown court for two assaults occasioning actual bodily harm.

One of these assaults was against Miss Donnell.

A judge sentenced him to a one-year suspended prison sentence, 200 hours of unpaid work and a curfew.

Judge Mallon told Hemphill that she was “staggered” that he had not gone to prison.

She deferred sentencing for the order breach for three months.

The judge told him she wanted to see first how he was getting on with the crown court order.

She warned Hemphill he faces prison if he fails to comply or commits any further offences.

He will be sentenced at the Huddersfield court on December 13.
