A driver who flipped his car onto its roof while more than twice the legal limit has been banned from the road.

David Bamford, of Victory Avenue, Paddock, was taken to hospital after his silver Honda Civic hit a wall and flipped over at Ainley Top.

The 55-year-old pleaded guilty to a charge of drink-driving.

Kirklees magistrates were told that the incident happened at just before 4pm on October 10.

Police were called to the scene of the smash on Grimescar Road, prosecutor Andy Wills said.

He told magistrates: “They saw the vehicle had lost control on the bend, collided with a wall and flipped onto its roof. Passing motorists stopped their vehicles to warn other drivers of the danger. They attended to the defendant who said: ‘I’ve lost my car, my job and my house’.”

An ambulance was called and Bamford was taken to Huddersfield Royal Infirmary.

He was escorted there by police and failed a breath test - despite claiming that he had only drunk one pint.

Bamford was arrested and further tests revealed that he had 79 microgrammes in 100 millilitres of breath. That is more than double the legal limit of 35 microgrammes.

Magistrates heard that Bamford had shared two bottles of wine with two other people the evening before the incident and had more alcohol when he got home.

Sonia Kidd, mitigating, said: “He believes that the resultant breath level was from a top up from the night before.

“He lost control of the car as when he’s driving he believed there was smoke coming from the back of the vehicle.

“Fortunately this gentleman sustained minor injuries, it could have been far worse.”

Magistrates heard that Bamford’s previous work had involved vehicles and included driving, spraying cars and fitting cats-eyes.

They banned him from driving for 17 months and told him to pay £100 fine, £85 costs and £20 victim surcharge.
