A man wearing only his boxer shorts was arrested following a fight at a house.

But Aaron Valvona was yesterday told at Kirklees Magistrates’ Court that it was not in the public interest to proceed with the case against him.

Prosecutor James Weekes said that on August 24 police responded to a fight at an address on Blackmoorfoot Road in Crosland Moor.

They found Valvona, 22, outside the property and he swore at them as he was upset at being unable to retrieve his keys and clothes.

His solicitor Mike Sisson-Pell said: “He was outside the premises in his boxer shorts, he’d been severely beaten.

“He was asking for his keys and clothes so that he could go home and was upset when police told him to leave the area in his underwear.”

Valvona, of Hexham Green in Milnsbridge, had pleaded not guilty to a charge of being drunk and disorderly in public.

Magistrates agreed to Mr Weekes’ request to withdraw the case.

He said: “Whilst it’s reprehensible conduct, I don’t see the public interest in going to trial for a matter that would receive only a small fine.”
