A MAN who took photos of a woman while raping and sexually molesting her as she slept has had his jail sentence cut.

Andrew Berry, 44, formerly of Radcliffe Road, Slaithwaite, was jailed for six years at Bradford Crown Court last August.

He had pleaded guilty to rape, three counts of assault by penetration and one of sexual assault.

But now Appeal Court judges in London have ruled the sentence "manifestly excessive" and cut Berry's term to five years.

Mr Justice Lloyd Jones, sitting with Lord Justice Pill and Mr Justice Newman, said Berry raped and sexually interfered with the sleeping woman early last year, all the while taking digital photos of her ordeal.

Both had been drinking and although the victim remembered "she was disturbed by a flashing light and felt Berry was on top of her" she did not wake up.

Mr Justice Lloyd Jones said the offences were made worse because Berry had taken the photos to keep a record of what he had done.

However, allowing the appeal and reducing Berry's sentence, the judge agreed that he had received insufficient credit for his guilty pleas.
