A former council worker, who falsely claimed council tax benefit, will not be prosecuted – if he pays the money back.

Floyd Peltier, 48, of Raw Nook Road, Salendine Nook, failed to declare a change in circumstances to claim just under £1,300 between June, 2009 and September, 2009, Bradford Crown Court heard yesterday.

But charges against the former Barnsley Council worker are to be dropped after Peltier agreed to repay the money plus a £388 penalty charge and £3,828 court costs.

NOTE: The case against Mr Peltier was later dropped. A spokesman for Kirklees Council said: "The council agreed to discontinue the prosecution against Mr Peltier if he accepted an administrative penalty as an alternative to prosecution."
