A teenager was spared jail yesterday for his role in a brutal attack on a shop worker which left him with a fractured cheekbone.

Mohammed Desai was knocked to the ground and repeatedly punched by three teenagers in an attack during his late-night shift at Dearne Valley Garage, Scissett.

Jamie Thompson, 18, of George A Green Road, Lupset, Wakefield, pleaded guilty to assaulting Mr Desai at a previous hearing.

Kirklees Magistrates’ Court heard the attack took place just after midnight on July 30. Prosecutor, Alex Bozman, said the trouble began when Mr Desai explained to the five youths that only two of them were able to be inside the garage at a time.

He said: “They didn’t take any notice and as a result he said they would have to leave. He tried to usher them out, there was a scuffle with one of the youths.

“The defendant accepts he punched him once to the face after he had been assaulted by one of the youths.”

In mitigation, Sarah Stewart, said her client had “convicted himself.” She said: “It’s to Mr Thompson’s credit because having watched the CCTV several times there was quite a brutal assault from two other lads but what he has said to me today is that this happened off-camera”

The bench gave him a community order for 12 months, 200 hours unpaid work and imposed a 12 week curfew from 7pm to 7am daily.

He was also ordered to pay £100 compensation to the victim and to pay another £145 in costs and victim surcharge.

The other two youths will be sentenced tomorrow.
