A WIDOW is suing Kirklees Council after her husband died from a lung disease.

Solicitors acting for Brenda Atkinson, of Victoria Court, Lockwood, have filed a writ in the Queen’s Bench Division of the High Court in London.

They are claiming damages of between £45,000 and £100,000 following the death of Peter Atkinson.

He was an assistant school caretaker and died from the industrial lung disease mesothelioma.

The writ says he was exposed to asbestos and its dust while working for the old Huddersfield Borough Council in 1958 and 1959.

Mr Atkinson died on October 27, 1994, aged 69.

Mesothelioma is an aggressive cancer of the lung lining caused by asbestos.

It can take up to 50 years to develop, but once diagnosed patients are given nine to 12 months to live.

A trial is due to be held in the High Court in November.
