Ashbrow Ward Clr Ken Smith has submitted to the council that the 2.4m high fence included as a condition in the original planning application should be removed on the grounds that:

There are many precedents for such spaces without fencing provision.

Fencing would obscure sighting of the play provision and would create a danger to any child using it; and the requirement is disproportionate to any need.

Chief officer for Deighton and Brackenhall Community Trust Andi Briggs told the Examiner: “The original conditions are that acoustic fencing be erected around the multi-use games area and the field but we are applying for a variation to this condition.

“We are content there have been no problems with noise from the games area which has been operational for around three months and feel the fencing would detract from the site.”

But he said the application would be withdrawn and resubmitted to allow more detailed assessment by the trust before being determined by Kirklees Council in September.
