A MAN who stole a £300 phone after asking to make a call has been told to pay up.

Christian Auty, 21, made off with an iPhone after his 19-year-old victim believed him to be a friend of a friend.

But Auty told his victim, Gary Cole, the phone was “jacked”, meaning stolen and there was a scuffle between them.

Mr Cole suffered a black eye as well as cuts and grazes during the early morning incident on John William Street in Huddersfield town centre nearly a year ago. He chased after Auty, but eventually stopped and contacted the police.

Last month Auty, of Birchington Close, Birchencliffe, pleaded guilty to theft.

Judge John Potter sentenced Auty to eight months in prison, but suspended the sentence for a year .

Under the terms of the suspended sentence order Auty will be subject to a curfew from 9pm to 6am each night for the next six weeks.

He will also be supervised for a year and must do 250 hours unpaid work for the community.

The court heard that Auty worked and there was no reason why he should not pay compensation of £300 to the student.
