A Dewsbury man has been jailed after he dislocated a woman’s elbow while on bail for previously giving her a black eye.

Leeds Crown Court heard Damian Auty was in a relationship with Suzanne Wood and had been drinking when he got into an argument with her at his home last August.

Felicity Hemlin prosecuting told the court he pushed her on to a sofa but then the row moved into the kitchen where he grabbed her round the throat.

A teenage girl who was in the house then saw him kick Miss Wood in the face twice causing the black eye and she stepped in between them to prevent further trouble. The complainant then left and Auty was charged and given bail on condition not to contact her.

On January 11 this year however the same complainant was at Auty’s home address in Mountain Road, Thornhill when she said he had twisted her arm behind her back dislocating it.

Miss Hemlin said Auty had previous convictions for affray and domestic violence and was given a suspended sentence for affray in November where he brandished an air pistol at a community interception key worker.

Franklyn Zakers representing Auty, said he had a problem in the past with alcohol dependency and that had played a part in his relationship with Miss Wood.

Auty, 36, had denied both assaults but was convicted by a district judge at Kirklees magistrates court of assault by beating on the first occasion and assault causing actual bodily harm on the second and his case was committed to the crown court for sentence.

Jailing him for a total of two years, Judge Jacqueline Davies said: “Domestic violence of this kind will not be tolerated by the courts.”
