A convicted killer murdered his second victim because he revealed he was HIV positive after they had sex, a report has told.

David Mitchell, 47, of Cowlersley, was given a whole life tariff in March for the brutal murder of convicted paedophile Robert Hind in December 2013.

Further details of the heinous crime have now emerged in a newly-released Prisons and Probation Ombudsman Investigation report.

Mitchell met Hind when they were both living at approved probation accommodation, a bail hostel, in Dewsbury in September 2013.

Mitchell later moved to his own home in Manchester Road, Cowlersley, and Hind remained at the hostel.

An investigation has found that both men had appropriate probation supervision and there was nothing they could have done to predict or prevent Hind’s death.

The subsequent report states it was not routine for staff to ask residents where they were going and as such Hind left the premises at 9am on December 12.

But police were alerted when Hind failed to meet his 3pm curfew and a manhunt was launched.

Mitchell, was later interviewed by police after it was found had phoned Hind days earlier and CCTV captured the pair together at Huddersfield Bus Station.

The Probation report reads: “When police questioned him, the second resident confessed that he had strangled the man and disposed of his body. He said that this was because the man had revealed that he was HIV positive after they had had sex.”

A post mortem later showed Mitchell had been punched or kicked or stamped on before being strangled with a ligature at Mitchell’s home after they had been drinking vodka together.

Later Mitchell admitted he had concealed the body in his cellar overnight.

The next day he was recorded on CCTV buying a hacksaw in Wilkinson’s store and a roll of bin bags in Poundland, two shops in Huddersfield.

Mitchell then dismembered the body in his bathroom shower using a knife and the hacksaw. the body was dumped in the Huddersfield Narrow Canal through Milnsbridge..

He subsequently pleaded guilty to murder having previously killed his girlfriend. Mitchell was jailed for life in 1991 and ordered to serve a minimum of 11 years for the murder of Kathleen McKenzie.

That had happened on November 4, 1990, when he taped her arms and legs together before running a bath and holding her head under the water drowning her at the home he then shared with her in Westgate, Almondbury.

He actually served 22 years nine months before his release on licence in on August 19, 2013 and met 46-year-old Robert Hind, known as Bob, when they were at the same hostel in Dewsbury. He has now been given a whole life tariff.

Mitchell had spent most of his adult life in prison and was very unfamiliar with any relationship when he was released and met Mr Hind, the report told.

Nigel Newcomen, Prisons and Probation Ombudsman, who produced the report, made a recommendation that the manager of approved premises should ensure that staff ask

residents where they are going when they leave the premises and make a record.
