A lorry driver has lost his licence after being caught drink-driving.

Augustine Dick, of Reinwood Road in Oakes, was stopped by police in the early hours of the morning.

The 58-year-old had held a Christmas party at his home the day earlier and his solicitor said that alcohol from that was still in his system.

Dick pleaded guilty to driving whilst over the prescribed limit when he appeared at Kirklees Magistrates’ Court.

Vanessa Jones, prosecuting, said that the offence occurred on December 28 last year.

At just before 1am Dick’s silver Citroen C5 was stopped as he drove along Reinwood Road near to his home.

When the police officers spoke with him they smelt alcohol on his breath and he was unsteady on his feet.

Dick was unable to provide a roadside breath test put further police station tests were successfully carried out.

These showed that he had 53 microgrammes of alcohol in 100 millilitres of breath.

The legal limit is 35 microgrammes.

Steven Kaye, mitigating, said that his client drove alone for a short distance while the roads were quiet.

He explained: “There was a Christmas party the night before on Boxing Day that he held at his house.

“The following day Mr Dick went about his daily business and had one further drink that evening.

“When he was stopped that second evening he was still over the limit.

“Mr Dick didn’t appreciate that the alcohol from the previous evening was still in his system.”

Mr Kaye added the full time HGV driver’s livelihood was on the line because of the “silly incident”.

Magistrates banned Dick from driving for 14 months.

He must also pay £150 fine, £85 costs and £20 victim surcharge.
