A MAN who told his ex-partner “You’re dead” in a dispute over their children has been banned from going near her house.

Peter McKinley, of Clare Hill, Huddersfield, made the threat after Beverley Arundel told him not to visit their 15-year-old daughter and 11-year-old son.

Huddersfield Magistrates’ Court heard McKinley, 46, had been given a harassment warning by police in August and was told any communication with their son was to go through Ms Arundel. On September 9 he contacted her to say he intended to visit her house in Crosland Moor, but got a response saying the children did not want to see him.

Paul Ramsay, prosecuting, said: “The complainant was scared he would turn up and left the house, taking the son.

“She informed her daughter the defendant would be in the area.”

Ms Arundel, who was waiting in a car down the road, saw McKinley arrive at the house and called the police.

After being arrested, McKinley told her: “You’re dead.”

Marnat Ali, mitigating, said McKinley had anger management problems. He added: “Up to very recently, the majority of his income was spent in supporting the complainant and her children, mortgage payments and financial assistance.

“He has insufficient funds to obtain independent legal advice, meaning his only way of contacting his children was through the complainant. Unfortunately he has been met with resistance.”

McKinley was given a 12-month community order, with Probation Service supervision and an order not to go within 100 yards of Ms Arundel’s address.

An additional prosecution request for a restraining order was denied.
