ONE of the two men accused of attacking Brighouse father-of-two, Sean Ellis, has been released from custody after a successful bail application in front of a crown court judge.
Mr Ellis was left fighting for his life after he was attacked near his home in the town last month.
During a court hearing last week a judge was told that he was still in a critical condition.
The 35-year-old suffered a fractured skull after being hit over the head during a disturbance in Smith House Avenue.
Yesterday Judge Jonathan Durham Hall QC heard submissions in chambers about the case and agreed to grant bail to Aaron Eccleston, 24, of Tile Terrace, Brighouse.
Eccleston and his co-accused Scott Mitchell, 24, of Marion Street, Brighouse, have both been charged with an offence of wounding Mr Ellis with intent. Mitchell is also expected to be released on bail shortly, but he remains in custody at present while arrangements are completed.
The two defendants are due to attend a plea and case management hearing on November 3 and a provisional trial date has been fixed for February 1 next year.
