A MAN has appeared in court accused of failing to provide a specimen of breath.
Paul Asgill, of St John’s Road in Kirkheaton, was before Kirklees magistrates yesterday.
He is accused of failing, without reasonable excuse, to provide samples for an investigation.
The alleged offence took place near to the 42-year-old’s home on November 11.
Linda Fowler, prosecuting, said that Asgill was stopped on suspicion of drink-driving.
She said that a roadside test was positive but Asgill refused to give further breath samples at the police station.
Asgill denies the charge, claiming that he had a reasonable excuse as he suffers from asthma.
Magistrates told him that his trial will take place in the Huddersfield court on February 13. Bail was granted.
