A LINDLEY man has appeared in court accused of failing to provide a specimen of breath.

Jaswinder Atwal, of Brian Street, was before Kirklees magistrates yesterday.

The alleged offence took place at the junction of Clare Hill and St John’s Road in Huddersfield on May 5.

Alex Bosman, prosecuting, said that at midnight police stopped the 42-year-old’s car.

He said the officers had been concerned about the way the vehicle had reacted when they tried to pass.

The prosecutor said that an empty bottle of vodka was found on the passenger seat and he was arrested.

However, Mr Bosman said that whilst at the police station Atwal failed to provide breath without a reasonable excuse.

Atwal denies the offence, claiming that he told officers about a medical condition.

Magistrates adjourned his case until September 11 when his trial will take place in the court.

Atwal was granted unconditional bail.
