An upset man threw a child’s pogo stick at a house after being asked to leave when he spilt some beer.

Mark Smith admitted criminal damage after smashing the window at the Dalton property.

Kirklees magistrates were told that the offence happened on January 11.

On that date Smith was visiting a relative at the address in Harpe Inge.

He was drinking from a can of beer in the living room but when that was knocked over he was asked to leave.

Smith, of Southfield Road in Almondbury , then ran back towards the privately rented property.

He smashed a downstairs window using a child’s pogo stick from the garden.

Smith, 39, made off on foot but was later arrested.

Jonathan Slawinski, mitigating, said that after being asked to leave the house his client became involved in an argument in the garden.

He said: “The child’s pogo stick was thrown at Mark.

“He accepts foolishly that he lost his temper and threw it towards the house.”

Magistrates gave Smith a conditional discharge.

He must still pay £200 compensation as well as court costs.
