A drunk man smashed a takeaway window and fought with his friend in the street when he snatched his burger from him, a court heard.

Matthew Stansfield, 31, admitted charges of criminal damage and threatening behaviour on July 9.

When he was arrested following the early hours incident in Huddersfield town centre he told police: “It was beer in, brains out – he nabbed my burger off me.”

Kirklees magistrates were told that it was just before 3am when Stansfield smashed the shop front window belonging to Chicken Hut.

A worker at the Cross Church Street premises said he heard shouting outside followed by a smashing sound.

Elizabeth Wright, prosecuting, said: “The damage was like a spider’s web effect on the glass.

“He (the staff member) goes outside and sees Mr Stansfield taking off his shirt and walking towards St Peter’s Church and shouting at somebody else.”

There Stansfield, of no fixed address, started fighting with his friend Ashley Sykes.

Miss Wright said that were hitting each other in the face and squaring up to each other.

When police arrived Stansfield ran away but was caught after a chase.

He was described as agitated and swore at the officers but admitted kicking the shop window.

Miss Wright said: “He said he remembered leaving the club and that he thinks he got a burger and chips.

“He said: ‘It was beer in, brains out. I had gone out with Sykes and been drinking. We normally get on but he nabbed my burger off me.’”

Magistrates heard that Stansfield and Mr Sykes were usually very good friends and had been in the Army together, completing a tour of Kosovo.

Stansfield admitted that his stolen burger resulted in a fight and that he kicked out at the takeaway window in frustration.

Magistrates ordered him to pay £1,000 compensation to fix the broken window, £350 fine, £85 costs and £35 victim surcharge.
