A man attacked a train passenger after becoming upset about loud music being played in his carriage.

But Kevin Fenton ended up the worse for wear after attacking Jonathan Smith on a train travelling to Huddersfield.

Kirklees magistrates heard that the 36-year-old was hurt as Mr Smith tried to defend himself against his punches.

Fenton spent four days in hospital having treatment for injuries including a damaged eye, lost two teeth and had a metal plate inserted in his cheekbone.

The incident happened on May 6 at 11.40pm.

Mr Smith had caught the service from Manchester Piccadilly to Dewsbury after an evening out with friends.

He sat down opposite two teenage girls who had attended a music festival in Manchester.

The girls decided to play some music and this upset Fenton, who was sitting nearby.

Andy Wills, prosecuting, said: “He said: ‘What’s that f*****g rubbish’ and they said nothing.

“They continued to play the music and he turned round and began shouting at the girls and commenting about the quality of their music.”

Fenton, of Osborne Street,Moldgreen, also became upset about Smith looking at him.

He asked him what he was looking at before continuing to shout abuse towards the girls.

Mr Smith tried to keep out of the row but Fenton then got to his feet and headed towards him. He felt threatened and got to his feet but Fenton swung his fist towards him.

Mr Smith raised his arms to try and protect himself and Fenton continued to try and hit him.

He received hospital treatment after suffering cuts to his lip and ear.

Fenton was arrested by police when the train arrived at Huddersfield Railway Station.

He had little recollection of the event.

John Ozyer, mitigating, said: “There was an argument between the defendant and the girls playing loud music and the situation escalated.

“While he (Fenton) was the aggressor in this he came off a lot worse than the person involved.”

Magistrates fined Fenton £220 and ordered him to pay £22 victim surcharge and ££85 costs.
