A MAN banned from a pub has been jailed after assaulting the manager.

Clinford Joseph was sent to prison by Kirklees magistrates after they heard details of the attack at the Cherry Tree pub in Huddersfield town centre.

Magistrates lost patience with Joseph, who has over 260 convictions to his name, after he refused to co-operate with previous court orders.

The bench heard how the 31-year-old turned up at the John William Street pub on January 24.

He was drunk and manager Christopher Oliver tried to stop him from entering further into the premises.

Linda Fowler, prosecuting, said: “The manager saw him trying to enter – he’s banned from the pub – and he approached him to stop him.”

Joseph, of Lonsbrough Flats in Southgate, left but soon afterwards managed to get inside without being seen.

Mr Oliver escorted him out with the help of a colleague, but this did not deter Joseph who returned again.

He fell to the floor after being pushed by Mr Oliver and retaliated.

Mrs Fowler said: “He (Joseph) was swearing: “I’m going to f*** you up, I’m going to kill you’.

“The defendant pushed him and swung a punch at his head which missed.”

He admitted the assault as well as two breaches of his community order.

In January Joseph was made subject to a community order for offences of assault, criminal damage and theft.

But on January 10 he failed to attend his induction appointment with the Probation Service and give an explanation for his absence.

The court heard previously how Joseph struggled with a chronic alcohol problem and that much of his offending was related to this.

Magistrates were told that Joseph, who has learning difficulties, found it difficult to keep appointments due to his ‘chaotic lifestyle’.

In mitigation, Neil Murphy said of his client: “He’s had a sad and difficult upbringing, a young man who’s gone into care at an early age. He can’t read and write and has a chronic addiction to alcohol”.

Magistrates jailed Joseph for eight weeks.

They told him that their decision was influenced by his record and failure to comply with court orders.
