A MAN drove after drinking - egged on by his mates to buy more booze.

But Malcolm Kelly was left to pay the price after magistrates banned him from driving for three years.

Kelly, of Penistone Road, Waterloo, admitted drink-driving in the early hours of July 9.

Linda Fowler, prosecuting, said that at 1am an officer on patrol in Milnsbridge spotted Kelly’s Renault Clio. He watched the car, which he described as being driven erratically, pull into a driveway on Lockbridge Way.

Mrs Fowler said: “He approached the driver, he smelt of intoxicants and his speech was slurred. Kelly was arrested for being unfit to drive and said he had been to the shop.”

Tests at the police station revealed that the 26-year-old had 70 microgrammes of alcohol in 100 millilitres of breath – twice the legal limit of 35mg.

Kirklees magistrates were told that Kelly already had a drink-driving offence on his record from 2010.

Bob Carr, his solicitor, said that Kelly had spent the evening out drinking with friends.

He said he had originally intended to leave his car at a friend’s house, but this plan changed. Mr Carr said: “His friends needed beer and they foolishly persuaded him to go and get it.

Magistrates were told that machine operator Kelly would have to be banned from driving for three years and the bench ordered Kelly to pay a £375 fine, £85 costs and a £15 surcharge.
